                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to tuition and fees charged to certain military personnel

 1-3     for certain courses at Midwestern State University.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 54.058(h), Education Code, is amended to

 1-6     read as follows:

 1-7           (h)  United States Army, Navy, Air Force, or Coast Guard

 1-8     personnel stationed outside the State of Texas who are enrolled in

 1-9     the bachelor of science or master of science degree program in

1-10     radiological sciences at Midwestern State University by

1-11     instructional telecommunication are [will be] entitled to pay

1-12     tuition fees and other fees or charges provided for Texas residents

1-13     if they began the program while stationed at an Air Force base,

1-14     Army base, Naval base, or other military installation in Texas as a

1-15     member of the United States Army, Navy, Air Force, or Coast Guard.

1-16     In this subsection, "instructional telecommunication" means

1-17     instruction delivered primarily by telecommunication technology,

1-18     including open-channel television, cable television, closed-circuit

1-19     television, low power television, communication and/or direct

1-20     broadcast satellite, satellite master antenna system, microwave,

1-21     videotape, videodisc, computer software, computer networks, and

1-22     telephone lines.

1-23           SECTION 2.  This Act applies beginning with the fall semester

1-24     1997.

 2-1           SECTION 3.  The importance of this legislation and the

 2-2     crowded condition of the calendars in both houses create an

 2-3     emergency and an imperative public necessity that the

 2-4     constitutional rule requiring bills to be read on three several

 2-5     days in each house be suspended, and this rule is hereby suspended,

 2-6     and that this Act take effect and be in force from and after its

 2-7     passage, and it is so enacted.
