                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the possession, use, manufacture, purchase,

 1-3     installation, transportation, or sale of chlorofluorocarbons.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 382.0205, Health and Safety Code, is

 1-6     amended to read as follows:

 1-7           Sec. 382.0205.  SPECIAL PROBLEMS RELATED TO AIR CONTAMINANT

 1-8     EMISSIONS.  (a)  Consistent with applicable federal law, the

 1-9     commission by rule may control air contaminants as necessary to

1-10     protect against adverse effects related to:

1-11                 (1)  acid deposition;

1-12                 (2)  stratospheric changes, including depletion of

1-13     ozone; and

1-14                 (3)  climatic changes, including global warming.

1-15           (b)  Notwithstanding Subsection (a) or any other law, the

1-16     commission may not prohibit the possession, use, manufacture,

1-17     purchase, installation, transport, or sale of chlorofluorocarbons.

1-18           (c)  The possession, use, manufacture, purchase,

1-19     installation, transportation, or sale of chlorofluorocarbons does

1-20     not subject a person to a penalty, fine, or other punitive measure.

1-21           SECTION 2.  This Act takes effect September 1, 1997.

1-22           SECTION 3.  The importance of this legislation and the

1-23     crowded condition of the calendars in both houses create an

1-24     emergency and an imperative public necessity that the

 2-1     constitutional rule requiring bills to be read on three several

 2-2     days in each house be suspended, and this rule is hereby suspended.
