                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to building permit fees charged to certain nonprofit

 1-3     corporations or organizations by certain municipalities.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Subchapter Z, Chapter 214, Local Government Code,

 1-6     is amended by adding Section 214.903 to read as follows:

 1-7           Sec. 214.903.  BUILDING PERMIT FEES FOR CERTAIN NONPROFIT

 1-8     ORGANIZATIONS.  (a)   This section applies only to a municipality

 1-9     with a population of 1.8 million or more.

1-10           (b)  A municipality may adopt rules relating to the issuance

1-11     of or cost of permits for construction or renovation of housing to:

1-12                 (1)  a community development corporation; or

1-13                 (2)  an organization that is exempt from taxation under

1-14     Section 501(a) or 501(c)(3) of the Internal Revenue Code of 1986

1-15     (26 U.S.C.  Sections 501(a) and (c)(3)).

1-16           SECTION 2.  This Act takes effect September 1, 1997.

1-17           SECTION 3.  The importance of this legislation and the

1-18     crowded condition of the calendars in both houses create an

1-19     emergency and an imperative public necessity that the

1-20     constitutional rule requiring bills to be read on three several

1-21     days in each house be suspended, and this rule is hereby suspended.
