                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to powers of certain nonresident insurance agents.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Articles 21.09 and 21.11, Insurance Code, are

 1-5     repealed.

 1-6           SECTION 2.  Section 3, Article 21.14, Insurance Code, is

 1-7     amended by adding Subsection (f) to read as follows:

 1-8           (f)  Notwithstanding Subsections (a) and (b) of this section,

 1-9     an individual licensed agent is not required to be a resident of

1-10     this state if the license is issued to the agent in accordance with

1-11     Section 3, Article 21.01-2, of this code.

1-12           SECTION 3.  This Act takes effect September 1, 1997, and

1-13     applies only to conduct occurring on or after that date.  Conduct

1-14     occurring before the effective date of this Act is governed by the

1-15     law as it existed immediately before the effective date of this

1-16     Act, and that law is continued in effect for that purpose.

1-17           SECTION 4.  The importance of this legislation and the

1-18     crowded condition of the calendars in both houses create an

1-19     emergency and an imperative public necessity that the

1-20     constitutional rule requiring bills to be read on three several

1-21     days in each house be suspended, and this rule is hereby suspended.
