                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the hours worked by peace officers employed by

 1-3     counties.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Chapter 157, Subchapter B, Section 157.022, Local

 1-6     Government Code is amended to read as follows:

 1-7           Sec. 157.022.  HOURS OF WORK OF PEACE OFFICERS IN COUNTIES OF

 1-8     MORE THAN ONE HUNDRED THOUSAND.  (a)  A peace officer employed by a

 1-9     county with a population of more than one hundred thousand may not

1-10     be required to work more hours during a calendar week than the

1-11     number of hours in the normal work week of the majority of other

1-12     county employees.

1-13           (b)  A sheriff or constable may require a peace officer to

1-14     work more hours than allowed by Subsection (a) if the sheriff or

1-15     constable determines an emergency exists that requires the officer

1-16     to work extra hours.

1-17           (c)  A peace officer who elects to work extra hours during a

1-18     calendar week shall be compensated on a basis consistent with

1-19     overtime provision of the county personnel policy.

1-20           SECTION 2.  This act takes effect September 01, 1997.

1-21           SECTION 3.  The importance of this legislation and the

1-22     crowded condition of the calendars in both houses created an

1-23     emergency and an imperative public necessity that the

1-24     constitutional rule requiring bills to be read on three several

 2-1     days in each house be suspended, and this rule is hereby suspended,

 2-2     and that this Act take effect and be in force from and after its

 2-3     passage, and it is so enacted.
