                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to highway route designations for non-radioactive

 1-3     hazardous materials.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 2(b), Article 6675d, Revised Statutes, is

 1-6     amended to read as follows:

 1-7           (b)  A safety rule adopted under this article prevails over a

 1-8     conflicting rule adopted by a local government, authority, or state

 1-9     agency or officer, other than a conflicting rule adopted by:

1-10                 (1)  the Railroad Commission of Texas under Chapter

1-11     113, Natural Resources Code; or

1-12                 (2)  the Texas Transportation Commission under Section

1-13     5(c) of this article.

1-14           SECTION 2.  Section 5, Article 6675d, Revised Statutes, is

1-15     amended by adding Subsection (c) to read as follows:

1-16           (c)  A rule adopted under this article concerning route

1-17     designations for non-radioactive hazardous materials shall provide

1-18     for the prior approval by the Executive Director of the Texas

1-19     Department of Transportation or his or her designee of any route

1-20     designated on a part of the state highway system.  If the Texas

1-21     Department of Transportation does not approve or disapprove a route

1-22     designation within 45 days of receipt of a request, the route shall

1-23     be deemed approved.

1-24           SECTION 3.  The importance of this legislation and the

 2-1     crowded condition of the calendars in both houses create an

 2-2     emergency and an imperative public necessity that the

 2-3     constitutional rule requiring bills to be read on three several

 2-4     days in each house be suspended, and this rule is hereby suspended,

 2-5     and that this Act take effect and be in force from and after its

 2-6     passage, and it is so enacted.
