                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the offense of arranging, conducting, or participating

 1-3     in certain drinking games.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Subchapter D, Chapter 101, Alcoholic Beverage

 1-6     Code, is amended by adding Section 101.76 to read as follows:

 1-7           Sec. 101.76.  CERTAIN DRINKING GAMES PROHIBITED.  (a)  A

 1-8     person commits an offense if the person arranges, conducts, or

 1-9     participates in a game if:

1-10                 (1)  the game includes the consumption of an alcoholic

1-11     beverage as an element of the game; and

1-12                 (2)  the primary purpose of the game is the

1-13     intoxication of the participants.

1-14           (b)  An offense under this section is a Class C misdemeanor.

1-15           SECTION 2.  This Act takes effect September 1, 1997.  The

1-16     change in law made by this Act applies only to an offense committed

1-17     on or after the effective date of this Act.  For purposes of this

1-18     section, an offense is committed before the effective date of this

1-19     Act if any element of the offense occurs before that date.

1-20           SECTION 3.  The importance of this legislation and the

1-21     crowded condition of the calendars in both houses create an

1-22     emergency and an imperative public necessity that the

1-23     constitutional rule requiring bills to be read on three several

1-24     days in each house be suspended, and this rule is hereby suspended.
