                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the fees paid in certain counties for the purpose of

 1-3     road and bridge maintenance and construction.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Amend Section 502.108 of the Transportation Code

 1-6     by adding paragraph (g) to read as follows:

 1-7           Section 502.108.  Use of Registration Fees Retained by County

 1-8     (g)  A commissioners court of a county with a population of 2.8

 1-9     million or more using funds provided under this chapter shall

1-10     allocate such funds proportionately during each fiscal year for

1-11     road projects among the unincorporated regions of the county and

1-12     each of the municipalities within the county.  This apportionment

1-13     must be based on the population of each of the municipalities and

1-14     of the unincorporated regions of the county.

1-15           SECTION 2.  This Act takes effect September 1, 1997.

1-16           SECTION 3.  The importance of this legislation and the

1-17     crowded condition of the calendars of both houses create an

1-18     emergency and an imperative public necessity that the

1-19     constitutional rule requiring that bills to be read on three

1-20     several days in each house be suspended, and this rule is hereby

1-21     suspended.
