                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the exemption of stated-owned real property from forced

 1-3     sale.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Chapter 43, Property Code, is amended by adding

 1-6     Section 43.002 to read as follows:

 1-7           Sec. 43.002.  EXEMPT STATE PROPERTY.  The real property of

 1-8     the state, including the real property held in the name of state

 1-9     agencies and funds, is exempt from attachment, execution, and

1-10     forced sale.  A judgment lien or abstract of judgment may not be

1-11     filed or perfected against the state or a unit of state government

1-12     or property owned by the state or a unit of state government; any

1-13     such judgment or abstract of judgment is void and unenforceable.

1-14           SECTION 2.  The importance of this legislation and the

1-15     crowded condition of the calendars in both houses create an

1-16     emergency and an imperative public necessity that the

1-17     constitutional rule requiring bills to be read on three several

1-18     days in each house be suspended, and this rule is hereby suspended,

1-19     and that this Act take effect and be in force from and after its

1-20     passage, and it is so enacted.
