A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to certain exemptions from the sex offender registration
1-3 requirement.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 8(b), Article 6252-13c.1, Revised
1-6 Statutes, is amended to read as follows:
1-7 (b) A person who has a reportable conviction or adjudication
1-8 for which the person is subject to registration under this article
1-9 may petition a district judge in the county where the person
1-10 resides or intends to reside for an exemption from this article.
1-11 After a hearing on the matter [If the person shows good cause], the
1-12 district judge may [shall] grant the exemption if the person
1-13 proves by a preponderance of the evidence specific facts indicating
1-14 that registration under this article would place the person's
1-15 health and well-being in immediate danger.
1-16 SECTION 2. This Act takes effect September 1, 1997.
1-17 SECTION 3. The importance of this legislation and the
1-18 crowded condition of the calendars in both houses create an
1-19 emergency and an imperative public necessity that the
1-20 constitutional rule requiring bills to be read on three several
1-21 days in each house be suspended, and this rule is hereby suspended.
