                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the transportation of hazardous materials in certain

 1-3     municipalities.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 7, Article 6675d, Revised Statutes, is

 1-6     amended by adding Subsection (f) to read as follows:

 1-7           (f)  A municipality with a population of more than 750,000

 1-8     shall develop a plan for routing commercial motor vehicles carrying

 1-9     hazardous materials on a road or highway in the municipality.  The

1-10     municipality shall submit the plan to the department for approval.

1-11     If the department determines that the plan complies with all

1-12     applicable federal and state regulations regarding the

1-13     transportation of hazardous materials, the department shall approve

1-14     the plan and notify the municipality and the Texas Department of

1-15     Transportation of the approved plan.  The Texas Department of

1-16     Transportation and the municipality shall post signs designating

1-17     the roads and highways in the city that may be used for the

1-18     transportation of hazardous materials.

1-19           SECTION 2.  The importance of this legislation and the

1-20     crowded condition of the calendars in both houses create an

1-21     emergency and an imperative public necessity that the

1-22     constitutional rule requiring bills to be read on three several

1-23     days in each house be suspended, and this rule is hereby suspended,

1-24     and that this Act take effect and be in force from and after its

 2-1     passage, and it is so enacted.
