                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the regulation of commercial burning of hazardous waste

 1-3     by cement kilns.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Subchapter C, Chapter 361, Health and Safety

 1-6     Code, is amended by adding Section 361.1025 to read as follows:

 1-7           Sec. 361.1025.  PROHIBITION ON BURNING IN CERTAIN AREAS.  The

 1-8     commission by rule shall prohibit the commercial burning of

 1-9     hazardous  waste by a cement kiln in a standard metropolitan

1-10     statistical area with a population of 1 million or more.

1-11           SECTION 2.  (a)  This Act takes effect September 1, 1997.

1-12           (b)  Except as provided by this subsection, Section 361.1025,

1-13     Health and Safety Code, as added by this Act, applies to an

1-14     application for a permit that is pending before the Texas Natural

1-15     Resource Conservation Commission on September 1, 1997, or filed

1-16     with the commission on or after September 1, 1997.  On September 1,

1-17     1998, an authorization in a permit in effect on September 1, 1997,

1-18     for the commercial burning of hazardous waste as described in

1-19     Section 361.1025, Health and Safety Code, as added by this Act,

1-20     expires.

1-21           SECTION 3.  The importance of this legislation and the

1-22     crowded condition of the calendars in both houses create an

1-23     emergency and an imperative public necessity that the

1-24     constitutional rule requiring bills to be read on three several

 2-1     days in each house be suspended, and this rule is hereby suspended.
