                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to court costs imposed on persons convicted of certain

 1-3     offenses.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.   Article 102.014(c), Code of Criminal Procedure,

 1-6     is amended to read as follows:

 1-7           (c)  A person convicted of an offense under Subtitle C, Title

 1-8     7, Transportation Code [the Uniform Act Regulating Traffic on

 1-9     Highways (Article 6701d, Vernon's Texas Civil Statutes)], when the

1-10     offense occurs within a school crossing zone as defined by Section

1-11     541.302 [20L] of that code [Act], shall pay as court costs $20 in

1-12     addition to other taxable court costs.  A person convicted of an

1-13     offense under Section 545.066, Transportation Code [104,  Uniform

1-14     Act Regulating Traffic on Highways (Article 6701d, Vernon's Texas

1-15     Civil Statutes)], shall pay as court costs $20 in addition to other

1-16     taxable court costs.  A person convicted of an offense under

1-17     Section 25.093 or 25.094 [4.25], Education Code, shall pay as

1-18     taxable court costs $20 in addition to other taxable court costs.

1-19     The additional court costs under this subsection shall be collected

1-20     in the same manner that other fines and taxable court costs in the

1-21     case are collected.

1-22           SECTION 2.   (a)  The change in law made by this Act applies

1-23     only to an offense committed on or after the effective date of this

1-24     Act.  For purposes of this subsection, an offense was committed

 2-1     before the effective date of this Act if any element of the offense

 2-2     occurred before that date.

 2-3           (b)  An offense committed before the effective date of this

 2-4     Act is covered by the law in effect when the offense was committed,

 2-5     and the former law is continued in effect for that purpose.

 2-6           SECTION 3.   This Act takes effect September 1, 1997.

 2-7           SECTION 4.   The importance of this legislation and the

 2-8     crowded condition of the calendars in both houses create an

 2-9     emergency and an imperative public necessity that the

2-10     constitutional rule requiring bills to be read on three several

2-11     days in each house be suspended, and this rule is hereby suspended.
