                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to personal leave for public school teachers.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Section 22.003, Education Code, is amended by

 1-5     adding Subsection (c) to read as follows:

 1-6           (c)  A school district may not reduce the daily salary rate

 1-7     of a teacher by more than the daily pay rate of a substitute for

 1-8     the teacher if:

 1-9                 (1)  the teacher is absent from work for personal or

1-10     family illness for a period exceeding the teacher's accumulated

1-11     days of personal leave; or

1-12                 (2)  the teacher takes assault leave under Subsection

1-13     (b), and the district later changes the leave status and charges

1-14     the leave against the teacher's personal leave for a period

1-15     exceeding the teacher's accumulated days of personal leave.

1-16           SECTION 2.  This Act applies beginning with the 1997-1998

1-17     school year.

1-18           SECTION 3.  The importance of this legislation and the

1-19     crowded condition of the calendars in both houses create an

1-20     emergency and an imperative public necessity that the

1-21     constitutional rule requiring bills to be read on three several

1-22     days in each house be suspended, and this rule is hereby suspended,

1-23     and that this Act take effect and be in force from and after its

1-24     passage, and it is so enacted.
