A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to minimum area and attendance requirements of school
1-3 districts that result from detaching school district territory to
1-4 create a new school district.
1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-6 SECTION 1. Section 13.102, Education Code, is amended to
1-7 read as follows:
1-8 Sec. 13.102. MINIMUM AREA AND ATTENDANCE REQUIREMENTS. (a)
1-9 A new district may [not] be created only with either:
1-10 (1) an area of at least [less than] nine square miles;
1-11 or
1-12 (2) at least [fewer than] 8,000 students in average
1-13 daily attendance.
1-14 (b) Each remaining [, and a] district must retain either:
1-15 (1) [may not be reduced to] an area of at least [less
1-16 than] nine square miles; or
1-17 (2) at least [fewer than] 8,000 students in average
1-18 daily attendance.
1-19 SECTION 2. The importance of this legislation and the
1-20 crowded condition of the calendars in both houses create an
1-21 emergency and an imperative public necessity that the
1-22 constitutional rule requiring bills to be read on three several
1-23 days in each house be suspended, and this rule is hereby suspended,
1-24 and that this Act take effect and be in force from and after its
2-1 passage, and it is so enacted.
