                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to certain requirements for a petition that initiates

 1-3     creation of a new school district by detaching territory from one

 1-4     or more existing school districts.

 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-6           SECTION 1.  Section 13.103, Education Code, is amended to

 1-7     read as follows:

 1-8           Sec. 13.103.  INITIATION OF DETACHMENT.  Creation of a new

 1-9     district by detachment is initiated by resolution of the board of

1-10     trustees of each district from which territory is to be detached or

1-11     by a petition presented to the commissioners court.  A petition

1-12     under this subchapter must:

1-13                 (1)  give the metes and bounds of the proposed new

1-14     district;

1-15                 (2)  be signed by at least five [10] percent of the

1-16     registered voters residing in the proposed area to be detached from

1-17     an existing district; and

1-18                 (3)  be addressed to the commissioners court of the

1-19     county in which the territory of the proposed district is located

1-20     or, if the territory is in more than one county, to the

1-21     commissioners court of each county in which the territory is

1-22     located.

1-23           SECTION 2.  The importance of this legislation and the

1-24     crowded condition of the calendars in both houses create an

 2-1     emergency and an imperative public necessity that the

 2-2     constitutional rule requiring bills to be read on three several

 2-3     days in each house be suspended, and this rule is hereby suspended,

 2-4     and that this Act take effect and be in force from and after its

 2-5     passage, and it is so enacted.
