                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the requirement that the holder of a discharged lien on

 1-3     a motor vehicle execute the discharge of the lien.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 501.115, Transportation Code, is amended

 1-6     to read as follows:

 1-7           Sec. 501.115.  DISCHARGE OF LIEN.  (a)  If the debt or claim

 1-8     secured by a lien has been satisfied, the lienholder[, on the

 1-9     demand of the owner,] shall:

1-10                 (1)  execute and deliver to the owner a discharge of

1-11     the lien on a form prescribed by the department; and

1-12                 (2)  on behalf of the owner, apply[.]

1-13           [(b)  The owner may present the discharge and certificate of

1-14     title] to the county assessor-collector [with an application] for a

1-15     new certificate of title.

1-16           (b)  On receipt of the application for a new certificate of

1-17     title, after each requirement of this chapter is met, including the

1-18     payment of any required fee, [and] the department shall issue a new

1-19     certificate of title.

1-20           SECTION 2.  The importance of this legislation and the

1-21     crowded condition of the calendars in both houses create an

1-22     emergency and an imperative public necessity that the

1-23     constitutional rule requiring bills to be read on three several

1-24     days in each house be suspended, and this rule is hereby suspended.
