A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the period of validity of and fees for a driver's
1-3 license, learner's permit, or personal identification certificate.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 521.101(f), Transportation Code, is
1-6 amended to read as follows:
1-7 (f) A certificate expires on a date specified by the
1-8 department, except that a certificate issued to a person 60 years
1-9 of age or older does not expire.
1-10 SECTION 2. Section 521.271, Transportation Code, is amended
1-11 to read as follows:
1-12 Sec. 521.271. LICENSE EXPIRATION. (a) Each original
1-13 driver's license and provisional license expires as follows:
1-14 (1) a driver's license expires on the first birthday
1-15 of the license holder occurring after the sixth [fourth]
1-16 anniversary of the date of the application;
1-17 (2) a provisional license expires on the earlier of:
1-18 (A) the 18th birthday of the license holder; or
1-19 (B) the first birthday of the license holder
1-20 occurring after the date of the application;
1-21 (3) an instruction permit expires on the first
1-22 birthday of the license holder occurring after the date of the
1-23 application; and
1-24 (4) an occupational license expires on the first
2-1 anniversary of the court order granting the license.
2-2 (b) A driver's license that is renewed expires on the sixth
2-3 [fourth] anniversary of the expiration date before renewal.
2-4 SECTION 3. Section 521.421, Transportation Code, is amended
2-5 by amending Subsections (a) and (b) and adding Subsection (f) to
2-6 read as follows:
2-7 (a) The fee for issuance or renewal of a license not
2-8 otherwise provided for by this section is $24 [$16].
2-9 (b) The fee for renewal of a Class M license is $32 [$21].
2-10 (f) If a Class A, B, or C driver's license includes an
2-11 authorization to operate a motorcycle or moped, the fee for the
2-12 driver's license is increased by $8.
2-13 SECTION 4. Section 521.422, Transportation Code, is amended
2-14 to read as follows:
2-15 Sec. 521.422. PERSONAL IDENTIFICATION CERTIFICATE FEE. The
2-16 fee for a personal identification certificate is:
2-17 (1) $15 [$10] for a person under 60 [65] years of age;
2-18 and
2-19 (2) $5 for a person 60 [65] years of age or older.
2-20 SECTION 5. Section 522.029, Transportation Code, is amended
2-21 by amending Subsection (a) and adding Subsection (f) to read as
2-22 follows:
2-23 (a) The fee for a commercial driver's license or commercial
2-24 driver learner's permit issued by the department is $60 [$40].
2-25 (f) If a commercial driver's license or commercial driver
2-26 learner's permit includes an authorization to operate a motorcycle
2-27 or moped, the fee for the driver's license or permit is increased
3-1 by $8.
3-2 SECTION 6. Sections 522.051(a)-(d), Transportation Code, are
3-3 amended to read as follows:
3-4 (a) An original commercial driver's license or commercial
3-5 driver learner's permit expires six [four] years after the
3-6 applicant's next birthday.
3-7 (b) A commercial driver's license or commercial driver
3-8 learner's permit issued to a person holding a Texas Class A, B, C,
3-9 or M license that would expire one year or more after the date of
3-10 issuance of the commercial driver's license or commercial driver
3-11 learner's permit expires six [four] years after the applicant's
3-12 next birthday.
3-13 (c) A commercial driver's license or commercial driver
3-14 learner's permit issued to a person holding a Texas Class A, B, C,
3-15 or M license that would expire less than one year after the date of
3-16 issuance of the commercial driver's license or commercial driver
3-17 learner's permit or that has been expired for less than one year
3-18 expires six [four] years after the expiration date shown on the
3-19 Class A, B, C, or M license.
3-20 (d) A commercial driver's license or commercial driver
3-21 learner's permit issued to a person holding a Texas Class A, B, C,
3-22 or M license that has been expired for at least one year but not
3-23 more than two years expires six [four] years after the applicant's
3-24 last birthday.
3-25 SECTION 7. Sections 522.052(b) and (c), Transportation Code,
3-26 are amended to read as follows:
3-27 (b) A renewal of a commercial driver's license that has been
4-1 expired for less than one year expires six [four] years after the
4-2 expiration date shown on the commercial driver's license.
4-3 (c) A renewal of a commercial driver's license that has been
4-4 expired for at least one year but not more than two years expires
4-5 six [four] years after the applicant's last birthday.
4-6 SECTION 8. The Department of Public Safety by rule may
4-7 provide for the staggered expiration of licenses, permits, and
4-8 certificates under Chapters 521 and 522, Transportation Code, so
4-9 that a proportionate number of licenses, permits, and certificates
4-10 expire each year. The fee for a license, permit, or certificate
4-11 issued for a period other than the period provided by those
4-12 chapters shall be prorated accordingly.
4-13 SECTION 9. The change in law made by this Act applies only
4-14 to a license, permit, or certificate issued or renewed on or after
4-15 the effective date of this Act.
4-16 SECTION 10. This Act takes effect September 1, 1997.
4-17 SECTION 11. The importance of this legislation and the
4-18 crowded condition of the calendars in both houses create an
4-19 emergency and an imperative public necessity that the
4-20 constitutional rule requiring bills to be read on three several
4-21 days in each house be suspended, and this rule is hereby suspended.
