A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the period of validity of and fees for a driver's
1-3 license or personal identification certificate.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 521.271, Transportation Code, is amended
1-6 to read as follows:
1-7 Sec. 521.271. LICENSE AND PERSONAL IDENTIFICATION
1-8 CERTIFICATE EXPIRATION. (a) Each original driver's license,
1-9 personal identification certificate, and provisional license
1-10 expires as follows:
1-11 (1) a driver's license or personal identification
1-12 certificate expires on the 60th [first] birthday of the license or
1-13 certificate holder [occurring after the fourth anniversary of the
1-14 date of the application];
1-15 (2) a provisional license expires on the earlier of:
1-16 (A) the 18th birthday of the license holder; or
1-17 (B) the first birthday of the license holder
1-18 occurring after the date of the application;
1-19 (3) an instruction permit expires on the first
1-20 birthday of the license holder occurring after the date of the
1-21 application; and
1-22 (4) an occupational license expires on the first
1-23 anniversary of the court order granting the license.
1-24 (b) A driver's license that is renewed expires on the fourth
2-1 anniversary of the expiration date before renewal.
2-2 (c) The department shall reissue the license or certificate
2-3 of a holder who is under 60 years of age without charge at 12-year
2-4 intervals to include changes in the pertinent information shown on
2-5 the license or certificate. This subsection does not affect the
2-6 right of a person to obtain a duplicate or corrected license or
2-7 certificate at another time or the obligation of the person to pay
2-8 the fee required for a duplicate license or certificate obtained at
2-9 another time.
2-10 SECTION 2. Section 521.421, Transportation Code, is amended
2-11 by amending the heading and Subsections (a) and (b) to read as
2-12 follows:
2-13 Sec. 521.421. LICENSE AND CERTIFICATE FEES; EXAMINATION
2-14 FEES. (a) The fee for issuance [or renewal] of a license or
2-15 personal identification certificate not otherwise provided for by
2-16 this section is:
2-17 (1) $85 if on the date of application the applicant is
2-18 at least 18 years of age but younger than 25 years of age;
2-19 (2) $75 if on the date of application the applicant is
2-20 at least 25 years of age but younger than 35 years of age;
2-21 (3) $60 if on the date of application the applicant is
2-22 at least 35 years of age but younger than 45 years of age;
2-23 (4) $40 if on the date of application the applicant is
2-24 at least 45 years of age but younger than 50 years of age;
2-25 (5) $20 if on the date of application the applicant is
2-26 at least 50 years of age but younger than 55 years of age; and
2-27 (6) $16 if on the date of application the applicant is
3-1 at least 55 years of age.
3-2 (b) The fee for renewal of a [Class M] license not otherwise
3-3 provided for by this section is $16 [$21].
3-4 SECTION 3. Section 521.421, Transportation Code, is amended
3-5 by adding Subsection (f) to read as follows:
3-6 (f) The department shall provide, on request of the
3-7 applicant, for payment in installments over a period of one year of
3-8 a fee prescribed by Subsection (a).
3-9 SECTION 4. Section 521.422, Transportation Code, is amended
3-10 to read as follows:
3-11 Sec. 521.422. PERSONAL IDENTIFICATION CERTIFICATE RENEWAL
3-12 FEE. The fee for a renewal of a personal identification
3-13 certificate is[:]
3-14 [(1) $10 for a person under 65 years of age; and]
3-15 [(2)] $5 for a person 60 [65] years of age or older.
3-16 SECTION 5. Section 521.123, Transportation Code, is amended
3-17 to read as follows:
3-18 Sec. 521.123. DESIGNATOR ON LICENSE ISSUED TO PERSON UNDER
3-19 21 YEARS OF AGE. (a) The department shall:
3-20 (1) designate and clearly mark as a provisional
3-21 license each original driver's license issued by the department to
3-22 a person who is under 18 years of age; and
3-23 (2) indicate "UNDER 21" on the face of each original,
3-24 renewed, or duplicate license issued to a person who is under 21
3-25 years of age.
3-26 (b) On request of a license holder who is at least 21 years
3-27 of age, the department shall remove an "UNDER 21" indication from
4-1 the holder's license without charge.
4-2 SECTION 6. Section 521.101(f), Transportation Code, is
4-3 amended to read as follows:
4-4 (f) On request of a certificate holder who is at least 21
4-5 years of age, the department shall remove an "UNDER 21" indication
4-6 from the holder's certificate without charge. [A certificate
4-7 expires on a date specified by the department.]
4-8 SECTION 7. A driver's license or personal identification
4-9 certificate for which a renewal application is filed on or after
4-10 the effective date of this Act is subject to the expiration and fee
4-11 provisions applicable to an original license or certificate under
4-12 Chapter 521, Transportation Code, as amended by this Act.
4-13 SECTION 8. This Act takes effect September 1, 1997.
4-14 SECTION 9. The importance of this legislation and the
4-15 crowded condition of the calendars in both houses create an
4-16 emergency and an imperative public necessity that the
4-17 constitutional rule requiring bills to be read on three several
4-18 days in each house be suspended, and this rule is hereby suspended.
