         Substitute the following for H.B. No. 1237:

                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the number of election clerks in a primary election

 1-3     whose service is payable with state funds.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 173.008(c), Election Code, is amended to

 1-6     read as follows:

 1-7           (c)  Rules adopted under this section must provide for state

 1-8     compensation for sufficient personnel to properly hold the primary,

 1-9     taking into account the number of registered voters, number of

1-10     votes cast in previous primary elections, method of voting, and

1-11     other relevant factors, but in no case may state compensation be

1-12     limited to fewer than three [two] clerks for each election precinct

1-13     containing 1,000 or more registered voters.

1-14           SECTION 2.  This Act takes effect September 1, 1997.

1-15           SECTION 3.  The importance of this legislation and the

1-16     crowded condition of the calendars in both houses create an

1-17     emergency and an imperative public necessity that the

1-18     constitutional rule requiring bills to be read on three several

1-19     days in each house be suspended, and this rule is hereby suspended.
