                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to delegating to municipal employees the authority to

 1-3     determine compliance with certain plat requirements.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 212.0115, Local Government Code, is

 1-6     amended by adding Subsection (i) to read as follows:

 1-7           (i)  The municipal authority responsible for approving plats

 1-8     may delegate, in writing, the ability to perform any of the

 1-9     authority's  responsibilities under this section to one or more

1-10     employees of the municipality or of a utility owned or operated by

1-11     the municipality. A binding decision of the employee or employees

1-12     under this subsection is appealable to the municipal authority.

1-13           SECTION 2.  The importance of this legislation and the

1-14     crowded condition of the calendars in both houses create an

1-15     emergency and an imperative public necessity that the

1-16     constitutional rule requiring bills to be read on three several

1-17     days in each house be suspended, and this rule is hereby suspended,

1-18     and that this Act take effect and be in force from and after its

1-19     passage, and it is so enacted.

1-21           Amend H.B. No. 1280 as follows:

1-22           (1)  On page 1, lines 10-11, strike "employees of the

1-23     municipality or of a utility owned or operated by the municipality"

1-24     and substitute "persons".

 2-1           (2)  On page 1, line 11, strike "employee or employees" and

 2-2     substitute "person or persons".
