No. 1280 By: Lucio 1-8 A BILL TO BE ENTITLED 1-9 AN ACT 1-10 relating to the delegation of municipal authority to determine 1-11 compliance with certain plat requirements 1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-13 SECTION 1. Section 212.0115, Local Government Code, is 1-14 amended by adding Subsection (i) to read as follows: 1-15 (i) The governing body of a municipality may delegate, in 1-16 writing, the ability to perform any of the responsibilities under 1-17 this section to one or more persons. A binding decision of the 1-18 person or persons under this subsection is appealable to the 1-19 municipal authority responsible for approving plats. 1-20 SECTION 2. The importance of this legislation and the 1-21 crowded condition of the calendars in both houses create an 1-22 emergency and an imperative public necessity that the 1-23 constitutional rule requiring bills to be read on three several 1-24 days in each house be suspended, and this rule is hereby suspended, 1-25 and that this Act take effect and be in force from and after its 1-26 passage, and it is so enacted. 1-27 * * * * *
