A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the designation of certain businesses as enterprise
1-3 projects under the enterprise zone program.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 2303.403, Government Code, is amended to
1-6 read as follows:
1-7 Sec. 2303.403. PROHIBITION ON QUALIFIED BUSINESS
1-8 CERTIFICATION. (a) If the department determines that the
1-9 governing body of an enterprise zone is not complying with this
1-10 chapter, the department shall prohibit the certification of a
1-11 qualified business in the zone until the department determines that
1-12 the governing body is complying with this chapter.
1-13 (b) The department may not designate more than 80 [65]
1-14 businesses as enterprise projects during any biennium.
1-15 (c) A governing body of an enterprise zone may not have more
1-16 than:
1-17 (1) four qualified businesses designated as enterprise
1-18 projects per enterprise zone if all or part of the enterprise zone
1-19 is in the jurisdiction of a municipality with a population of more
1-20 than 50,000; or
1-21 (2) two qualified businesses designated as enterprise
1-22 projects per enterprise zone if all or part of the enterprise zone
1-23 is in the jurisdiction of a municipality with a population equal to
1-24 or less than 50,000.
2-1 SECTION 2. This Act takes effect September 1, 1997.
2-2 SECTION 3. The importance of this legislation and the
2-3 crowded condition of the calendars in both houses create an
2-4 emergency and an imperative public necessity that the
2-5 constitutional rule requiring bills to be read on three several
2-6 days in each house be suspended, and this rule is hereby suspended.
