By Chavez H.B. No. 1420 75R3193 JMC-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the enforcement of a juvenile court order for 1-3 restitution. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 54.07, Family Code, is amended by adding 1-6 Subsection (d) to read as follows: 1-7 (d) If the juvenile court renders judgment against a child 1-8 under Subsection (c) for defaulting on the payment of court-ordered 1-9 restitution, the judgment may be treated as a judgment rendered 1-10 against a parent of the child for the purpose of enforcing the 1-11 judgment under Subsection (c). 1-12 SECTION 2. (a) The change in law made by this Act applies 1-13 only to a court order issued in a disposition for conduct that 1-14 occurs on or after the effective date of this Act. Conduct 1-15 violating a penal law of the state occurs on or after the effective 1-16 date of this Act if every element of the violation occurs on or 1-17 after that date. 1-18 (b) Conduct that occurs before the effective date of this 1-19 Act is covered by the law in effect at the time the conduct 1-20 occurred, and the former law is continued in effect for that 1-21 purpose. 1-22 SECTION 3. This Act takes effect September 1, 1997. 1-23 SECTION 4. The importance of this legislation and the 1-24 crowded condition of the calendars in both houses create an 2-1 emergency and an imperative public necessity that the 2-2 constitutional rule requiring bills to be read on three several 2-3 days in each house be suspended, and this rule is hereby suspended.
