                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to payment bonds on certain public works contracts.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Section 2253.021, Government Code, is amended by

 1-5     adding Subsection (f) to read as follows:

 1-6           (f)  A payment bond is not required for the portion of a

 1-7     design/build contract that includes design services only.

 1-8           SECTION 2.  Section 2253.027, Government Code, is repealed.

 1-9           SECTION 3.  This Act takes effect September 1, 1997.

1-10           SECTION 4.  The changes in law made by this Act apply only to

1-11     a public works contract entered into on or after September 1, 1997.

1-12     A public works contract entered into before September 1, 1997, is

1-13     governed by the law in effect on the date the contract was entered

1-14     into, and that law is continued in effect for that purpose.

1-15           SECTION 5.  The importance of this legislation and the

1-16     crowded condition of the calendars in both houses create an

1-17     emergency and an imperative public necessity that the

1-18     constitutional rule requiring bills to be read on three several

1-19     days in each house be suspended, and this rule is hereby suspended.
