A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the fee for and term of state registration as a
1-3 noncommissioned security officer.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Sections 17(a) and (d), Private Investigators and
1-6 Private Security Agencies Act (Article 4413(29bb), Vernon's Texas
1-7 Civil Statutes), are amended to read as follows:
1-8 (a) The [If the General Appropriations Act does not specify
1-9 the amount of the fee, the] board by rule shall establish
1-10 reasonable and necessary fees that produce funds sufficient for the
1-11 administration of this Act but that do not produce unnecessary fund
1-12 balances and do not exceed the following amounts:

3-1 (d) A Class A, Class B, or Class C license is valid for one
3-2 year from the date of issuance. Registration as a private
3-3 investigator, manager, branch office manager, alarm systems
3-4 installer, security consultant, security sales person, alarm
3-5 systems monitor, or dog trainer is valid for two years from the
3-6 date of registration, except that an initial registration as an
3-7 alarm systems installer or security sales person is valid for one
3-8 year from the date of registration if the board requires
3-9 registrants to be trained or tested pursuant to Section 32(f) of
3-10 this Act. Registration as an owner, officer, partner, or
3-11 shareholder of a licensee is valid for two years from the date of
3-12 registration. Registration as a noncommissioned security officer
3-13 is valid for two [four] years from the date of registration. A
3-14 letter of authority, or a school approval or school instructor
3-15 approval letter issued by the board, is valid for one year from the
3-16 date of issuance. Other licenses or registrations issued under
3-17 this Act are valid for the period specified by this Act or by board
3-18 rule.
3-19 SECTION 2. This Act takes effect September 1, 1997. The
3-20 change in law made by this Act applies only to original and renewal
3-21 registrations that occur on or after the effective date of this
3-22 Act. A renewal or original registration that occurs before the
3-23 effective date of this Act is subject to the law in effect at the
3-24 time of the registration, and the former law is continued in effect
3-25 for that purpose.
3-26 SECTION 3. The importance of this legislation and the
3-27 crowded condition of the calendars in both houses create an
4-1 emergency and an imperative public necessity that the
4-2 constitutional rule requiring bills to be read on three several
4-3 days in each house be suspended, and this rule is hereby suspended.
