                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to circumstances under which certain firefighters and

 1-3     police officers may be required to take a polygraph examination.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 143.124(a), Local Government Code, is

 1-6     amended to read as follows:

 1-7           (a)  A fire fighter or police officer employed by the

 1-8     municipality may not be required to submit to a polygraph

 1-9     examination as part of an internal investigation regarding the

1-10     conduct of the fire fighter or police officer unless[:]

1-11                 [(1)]  the complainant submits to and passes a

1-12     polygraph examination and, if applicable, the department has

1-13     complied with Subsection (c) [; or]

1-14                 [(2)  the fire fighter or police officer is ordered to

1-15     take an examination under Subsection (f)].

1-16           SECTION 2.  Section 143.124(f), Local Government Code, is

1-17     repealed.

1-18           SECTION 3.  The importance of this legislation and the

1-19     crowded condition of the calendars in both houses create an

1-20     emergency and an imperative public necessity that the

1-21     constitutional rule requiring bills to be read on three several

1-22     days in each house be suspended, and this rule is hereby suspended,

1-23     and that this Act take effect and be in force from and after its

1-24     passage, and it is so enacted.
