                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to credit for military service in the Texas County and

 1-3     District Retirement System.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 843.601(d), Government Code, is amended

 1-6     to read as follows:

 1-7           (d)  A member eligible to establish credit under this section

 1-8     is one who:

 1-9                 (1)  [does not receive and is not eligible to receive

1-10     federal retirement payments based on 20 years or more of active

1-11     federal military duty or its equivalent;]

1-12                 [(2)]  has been released from military duty under

1-13     honorable conditions [not dishonorable];

1-14                 (2) [(3)]  became a member of the retirement system

1-15     after release from military duty;  and

1-16                 (3) [(4)]  has credit [performed as an employee at

1-17     least 10 years of service that is credited] in the retirement

1-18     system for service performed after the member's date of release

1-19     from active military duty.

1-20           SECTION 2.  The importance of this legislation and the

1-21     crowded condition of the calendars in both houses create an

1-22     emergency and an imperative public necessity that the

1-23     constitutional rule requiring bills to be read on three several

1-24     days in each house be suspended, and this rule is hereby suspended,

 2-1     and that this Act take effect and be in force from and after its

 2-2     passage, and it is so enacted.
