                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to continuing education for auctioneers.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Section 3B, Chapter 320, Acts of the 64th

 1-5     Legislature, Regular Session, 1975 (Article 8700, Vernon's Texas

 1-6     Civil Statutes), is amended to read as follows:        

 1-7           Sec. 3B. CONTINUING EDUCATION PROGRAMS.  (a) A person

 1-8     licensed under this Act must, in order to renew the license,

 1-9     complete not fewer than 14 hours of continuing education in

1-10     programs approved by the commission in the field of auctioneering

1-11     in each two-year period that the person is licensed under this Act.

1-12           (b)  A person applying to renew an auctioneer or associate

1-13     auctioneer license must provide to the commission proof that the

1-14     person has completed the continuing education requirements of this

1-15     section.

1-16           (c)  The commissioner shall adopt rules under this section

1-17     for the approval of continuing education programs [The commissioner

1-18     may recognize, prepare, or administer continuing education programs

1-19     for licensees.  Participation in the programs is voluntary].

1-20           SECTION 2.  (a) Except as provided by Subsection (b), this

1-21     Act takes effect September 1, 1997.

1-22           (b)  A person applying to renew an auctioneer or associate

1-23     auctioneer license is not required to comply with Section 3B(b),

1-24     Chapter 320, Acts of the 64th Legislature, Regular Session, 1975

 2-1     (Article 8700, Vernon's Texas Civil Statutes), as added by this

 2-2     Act, until September 1, 1999.

 2-3           SECTION 3.  The importance of this legislation and the

 2-4     crowded condition of the calendars in both houses create an

 2-5     emergency and an imperative public necessity that the

 2-6     constitutional rule requiring bills to be read on three several

 2-7     days in each house be suspended, and this rule is hereby suspended.
