                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the definition of air pollution.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Section 382.003(3), Health and Safety Code, is

 1-5     amended to read as follows:

 1-6                 (3)  "Air pollution" means the presence in the

 1-7     atmosphere of one or more air contaminants or combination of air

 1-8     contaminants in such concentration and of such duration that[:]

 1-9                       [(A)]  are or may tend to be injurious to or to

1-10     adversely affect human health or welfare, animal life, vegetation,

1-11     or property[; or]

1-12                       [(B)  interfere with the normal use or enjoyment

1-13     of animal life, vegetation, or property].

1-14           SECTION 2.  (a)  This Act takes effect September 1, 1997.

1-15           (b)  The change in law made by Section 382.003(3), Health and

1-16     Safety Code, as amended by this Act, applies only to a permit

1-17     application that is submitted to the Texas Natural Resource

1-18     Conservation Commission on or after September 1, 1997.  A person

1-19     who on September 1, 1997, holds a permit issued by the Texas

1-20     Natural Resource Conservation Commission under Chapter 382, Health

1-21     and Safety Code, shall continue to comply with the terms of that

1-22     permit until the permit is amended.

1-23           SECTION 3.  The importance of this legislation and the

1-24     crowded condition of the calendars in both houses create an

 2-1     emergency and an imperative public necessity that the

 2-2     constitutional rule requiring bills to be read on three several

 2-3     days in each house be suspended, and this rule is hereby suspended.
