                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to compensation of school district trustees.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Section 11.061(d), Education Code, is amended to

 1-5     read as follows:

 1-6           (d)  The trustees serve without compensation, unless

 1-7     compensation of a specified amount, not to exceed $500 annually, is

 1-8     approved by a majority of the votes cast at an election held by the

 1-9     district.  The trustees may not hold an election solely for the

1-10     purpose of submitting a measure on trustee compensation to the

1-11     voters.  Notwithstanding this subsection, a trustee may not receive

1-12     compensation if the trustee:

1-13                 (1)  holds an office other than the position of trustee

1-14     that is considered a civil office of emolument under Section 40,

1-15     Article XVI, Texas Constitution; or

1-16                 (2)  receives other compensation directly or indirectly

1-17     from the state.

1-18           SECTION 2.  The importance of this legislation and the

1-19     crowded condition of the calendars in both houses create an

1-20     emergency and an imperative public necessity that the

1-21     constitutional rule requiring bills to be read on three several

1-22     days in each house be suspended, and this rule is hereby suspended,

1-23     and that this Act take effect and be in force from and after its

1-24     passage, and it is so enacted.
