                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to water quality protection zones.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Section 26.179, Water Code, as added by Chapter

 1-5     975, Acts of the 74th Legislature, Regular Session, 1995, is

 1-6     amended by adding Subsections (o) and (p) to read as follows:

 1-7           (o)  If a municipality's action results in part of a zone

 1-8     being located outside the municipality's extraterritorial

 1-9     jurisdiction, the entire zone is removed from the municipality's

1-10     extraterritorial jurisdiction.  A zone removed from a

1-11     municipality's extraterritorial jurisdiction may not be brought

1-12     into the municipality's extraterritorial jurisdiction before the

1-13     20th anniversary of the date on which the zone was designated.

1-14           (p)  In addition to the fees authorized under subsection (g)

1-15     of this section, the commission shall adopt and assess reasonable

1-16     and necessary fees adequate to recover the commission's costs in

1-17     monitoring water quality associated with water quality protection

1-18     zones.

1-19           SECTION 2.  Section 1 of this Act applies to any action taken

1-20     by a municipality after January 1, 1997.

1-21           SECTION 3.  The importance of this legislation and the

1-22     crowded condition of the calendars in both houses create an

1-23     emergency and an imperative public necessity that the

1-24     constitutional rule requiring bills to be read on three several

 2-1     days in each house be suspended, and this rule is hereby suspended,

 2-2     and that this Act take effect and be in force from and after its

 2-3     passage, and it is so enacted.
