                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to water quality protection zones.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Section 26.179, Water Code, is amended by adding

 1-5     subsections (o) and (p) to read as follows:

 1-6           (o)  If a municipality's action results in part of a zone

 1-7     being located outside the extraterritorial jurisdiction of the

 1-8     municipality, then the entire zone shall be deemed to have been

 1-9     removed from the extraterritorial jurisdiction.  A zone removed

1-10     from a municipality's extraterritorial jurisdiction pursuant to

1-11     this paragraph may not be brought into the municipality's

1-12     extraterritorial jurisdiction before the expiration of ten years

1-13     from the date the zone was removed.

1-14           (p)  The commission may utilize fees assessed under this

1-15     section for the purpose of administering this section.

1-16           SECTION 2.  The importance of this legislation and the

1-17     crowded condition of the calendars in both houses create an

1-18     emergency and an imperative public necessity that the

1-19     constitutional rule requiring bills to be read on three several

1-20     days in each house be suspended, and this rule is hereby suspended.
