                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to certain reports under the federal Emergency Planning

 1-3     and Community Right-to-Know Act.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Subtitle D, Title 6, Health and Safety Code, is

 1-6     amended by adding Chapter 504 to read as follows:

 1-7        CHAPTER 504.  EMERGENCY PLANNING AND COMMUNITY RIGHT-TO-KNOW

 1-8                                 INFORMATION

 1-9           Sec. 504.001.  COMPILATION OF LIST.  The Texas Natural

1-10     Resource Conservation Commission shall compile a list of persons in

1-11     the state that Section 312 of the Emergency Planning and Community

1-12     Right-to-Know Act of 1986 (42 U.S.C. Section 11022) requires to

1-13     submit an emergency and hazardous chemical inventory form that

1-14     contains tier I information, as described by Subsection (d) of that

1-15     section.  The commission shall:

1-16                 (1)  list the persons alphabetically and according to

1-17     the county in which the facility owned or operated by the person is

1-18     located;

1-19                 (2)  indicate on the list which of those persons has

1-20     not submitted the required inventory form;

1-21                 (3)  revise the list annually; and

1-22                 (4)  make the list available to a member of the public

1-23     on request and available for public inspection in each of the

1-24     agency's offices.

 2-1           SECTION 2.  The importance of this legislation and the

 2-2     crowded condition of the calendars in both houses create an

 2-3     emergency and an imperative public necessity that the

 2-4     constitutional rule requiring bills to be read on three several

 2-5     days in each house be suspended, and this rule is hereby suspended,

 2-6     and that this Act take effect and be in force from and after its

 2-7     passage, and it is so enacted.
