                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the reconciliation of county checks and warrants.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Subchapter A, Chapter 113, Local Government Code,

 1-5     is amended by adding Section 113.008 to read as follows:

 1-6           Sec. 113.008.  RECONCILIATION OF COUNTY CHECKS AND WARRANTS.

 1-7     (a)  The county depository shall provide all canceled checks and

 1-8     warrants and supporting statements to the county treasurer or the

 1-9     person performing the duties of the county treasurer.

1-10           (b)  In fulfilling the requirements of Subsection (a), the

1-11     county depository may provide:

1-12                 (1)  original canceled checks and warrants; or

1-13                 (2)  optical images of the canceled checks and warrants

1-14     if the optical images are provided in accordance with the rules

1-15     adopted by the Texas State Library and Archives Commission.

1-16           (c)  The county treasurer shall:

1-17                 (1)  reconcile the canceled checks and warrants with

1-18     the account records of the depository; and

1-19                 (2)  ensure all financial adjustments are made

1-20     regarding the account as required.

1-21           SECTION 2.  The importance of this legislation and the

1-22     crowded condition of the calendars in both houses create an

1-23     emergency and an imperative public necessity that the

1-24     constitutional rule requiring bills to be read on three several

 2-1     days in each house be suspended, and this rule is hereby suspended.
