Subchapter A, Chapter 113, Local Government Code, 1-15 is amended by adding Section 113.008 to read as follows: 1-16 Sec. 113.008. RECONCILIATION OF COUNTY CHECKS AND WARRANTS. 1-17 (a) The county depository shall provide all canceled checks and 1-18 warrants and supporting statements to the county treasurer. 1-19 (b) Subsection (a) does not apply if the checks and 1-20 warrants are payable from funds under the direct authority of an 1-21 official other than the county treasurer as provided by statute. 1-22 The exemption provided by this subsection does not apply if the 1-23 official requests the county treasurer to be responsible for the 1-24 reconciliation of the checks and warrants payable from the funds 1-25 that are under the direct authority of the official. 1-26 (c) In fulfilling the requirements of Subsection (a), the 1-27 county depository shall provide, at the direction of the county 1-28 treasurer: 1-29 (1) original canceled checks and warrants; or 1-30 (2) optical images of the front and back of canceled 1-31 checks and warrants if the optical images are provided in 1-32 accordance with the rules adopted by the Texas State Library and 1-33 Archives Commission. 1-34 (d) The county treasurer shall: 1-35 (1) reconcile the canceled checks and warrants with 1-36 the account records of the depository; and 1-37 (2) ensure all financial adjustments are made 1-38 regarding the depository account as required. 1-39 (e) In this section, a reference to the county treasurer 1-40 includes a person performing the duties of the county treasurer. 1-41 SECTION 2. The importance of this legislation and the 1-42 crowded condition of the calendars in both houses create an 1-43 emergency and an imperative public necessity that the 1-44 constitutional rule requiring bills to be read on three several 1-45 days in each house be suspended, and this rule is hereby suspended. 1-46 * * * * *
