                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the disclosure of accident and traffic law conviction

 1-3     information by the Department of Public Safety.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 521.046(a), Transportation Code, is

 1-6     amended to read as follows:

 1-7           (a)  In addition to the information authorized to be released

 1-8     under Section 521.045, on receipt of a written request and payment

 1-9     of a $6 fee, the department may disclose that information and

1-10     information regarding each reported traffic law conviction for a

1-11     moving violation, as defined by department rule, and each motor

1-12     vehicle accident in which the individual received a citation, by

1-13     date and location, within the three years preceding the date of the

1-14     request, to a person who:

1-15                 (1)  demonstrates a legitimate need for the

1-16     information; and

1-17                 (2)  submits to the department the individual's

1-18     driver's license number or the individual's full name and date of

1-19     birth.

1-20           SECTION 2.  This Act takes effect September 1, 1997.

1-21           SECTION 3.  The importance of this legislation and the

1-22     crowded condition of the calendars in both houses create an

1-23     emergency and an imperative public necessity that the

1-24     constitutional rule requiring bills to be read on three several

 2-1     days in each house be suspended, and this rule is hereby suspended.
