A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to assignment of claims by public employees.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Civil Practice and Remedies Code, Chapter 102 is
1-5 amended by adding the following:
1-6 Chapter 102.007. PROHIBITION OF ASSIGNMENT OF CLAIM BY
1-7 PUBLIC EMPLOYEES. (a) A public employee is prohibited from
1-8 entering into a covenant not to execute or an assignment of claim
1-9 against their local government employer. Any such agreement is
1-10 hereby declared void as against the public policy of this state.
1-11 (b) The prohibition in (a) only applies to a local
1-12 government that is self-insured or who indemnifies their employees.
1-13 SECTION 2. The importance of this legislation and the
1-14 crowded condition of the calendars in both houses create an
1-15 emergency and an imperative public necessity that the
1-16 constitutional rule requiring bills to be read on three several
1-17 days in each house be suspended, and this rule is hereby suspended.
