1-1                                   AN ACT

 1-2     relating to the tuition charged to certain foreign students with

 1-3     financial need at certain components of the Texas State Technical

 1-4     College System and at Texas A&M University--Corpus Christi.

 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-6           SECTION 1.  Sections 54.060(b) and (d), Education Code, are

 1-7     amended to read as follows:

 1-8           (b)  The foreign student tuition fee prescribed in this

 1-9     chapter does not apply to a foreign student who is a resident of a

1-10     nation situated adjacent to Texas, who registers in any general

1-11     academic teaching institution, as defined in Section 61.003(3) of

1-12     this code, or component of the Texas State Technical College System

1-13     in a county immediately adjacent to the nation in which the foreign

1-14     student resides or who registers for lower division courses at a

1-15     community or junior college having a partnership agreement pursuant

1-16     to Subchapter N, Chapter 51, of this code, with an upper-level

1-17     university and both institutions are located in the county

1-18     immediately adjacent to the nation in which the foreign student

1-19     resides, or who registers in Texas A&M University--Kingsville or

1-20     Texas A&M University--Corpus Christi, and, except as provided by

1-21     this subsection, who demonstrates a financial need after the

1-22     financial resources of the foreign student and the student's family

1-23     are considered.  The foreign student described in this subsection

1-24     [section] shall pay tuition equal to that charged Texas residents

 2-1     under Sections 54.051 and 54.0512 of this code.  The coordinating

 2-2     board shall adopt rules governing the determination of financial

 2-3     need of students under this subsection and rules governing a pilot

 2-4     project to be established at general academic teaching institutions

 2-5     and at components of the Texas State Technical College System in

 2-6     counties that are not immediately adjacent to the nation in which

 2-7     the foreign student resides.

 2-8           (d)  The coordinating board shall adopt rules to determine

 2-9     the number of students who may participate in the programs provided

2-10     by Subsections (b) and (c) of this section and the students who may

2-11     transfer from any general academic teaching institution or

2-12     component of the Texas State Technical College System in a county

2-13     immediately  adjacent to the nation in which the foreign student

2-14     resides to attend another [a] general academic teaching institution

2-15     or component of the Texas State Technical College System  to

2-16     complete a degree, certificate, or diploma or attend graduate

2-17     school.

2-18           SECTION 2.  This Act applies beginning with tuition charged

2-19     for the 1997 fall semester.

2-20           SECTION 3.  The importance of this legislation and the

2-21     crowded condition of the calendars in both houses create an

2-22     emergency and an imperative public necessity that the

2-23     constitutional rule requiring bills to be read on three several

2-24     days in each house be suspended, and this rule is hereby suspended,

2-25     and that this Act take effect and be in force from and after its

2-26     passage, and it is so enacted.
