1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to the tuition charged to certain foreign students with
1-9 financial need at certain components of the Texas State Technical
1-10 College System and at Texas A&M University--Corpus Christi.
1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12 SECTION 1. Sections 54.060(b) and (d), Education Code, are
1-13 amended to read as follows:
1-14 (b) The foreign student tuition fee prescribed in this
1-15 chapter does not apply to a foreign student who is a resident of a
1-16 nation situated adjacent to Texas, who registers in any general
1-17 academic teaching institution, as defined in Section 61.003(3) of
1-18 this code, or component of the Texas State Technical College System
1-19 in a county immediately adjacent to the nation in which the foreign
1-20 student resides or who registers in Texas A&M
1-21 University--Kingsville or Texas A&M University--Corpus Christi,
1-22 and, except as provided by this subsection, who demonstrates a
1-23 financial need after the financial resources of the foreign student
1-24 and the student's family are considered. The foreign student
1-25 described in this subsection [section] shall pay tuition equal to
1-26 that charged Texas residents under Sections 54.051 and 54.0512 of
1-27 this code. The coordinating board shall adopt rules governing the
1-28 determination of financial need of students under this subsection
1-29 and rules governing a pilot project to be established at general
1-30 academic teaching institutions and at components of the Texas State
1-31 Technical College System in counties that are not immediately
1-32 adjacent to the nation in which the foreign student resides.
1-33 (d) The coordinating board shall adopt rules to determine
1-34 the number of students who may participate in the programs provided
1-35 by Subsections (b) and (c) of this section and the students who may
1-36 transfer from any general academic teaching institution or
1-37 component of the Texas State Technical College System in a county
1-38 immediately adjacent to the nation in which the foreign student
1-39 resides to attend another [a] general academic teaching institution
1-40 or component of the Texas State Technical College System to
1-41 complete a degree, certificate, or diploma or attend graduate
1-42 school.
1-43 SECTION 2. This Act applies beginning with tuition charged
1-44 for the 1997 fall semester.
1-45 SECTION 3. The importance of this legislation and the
1-46 crowded condition of the calendars in both houses create an
1-47 emergency and an imperative public necessity that the
1-48 constitutional rule requiring bills to be read on three several
1-49 days in each house be suspended, and this rule is hereby suspended,
1-50 and that this Act take effect and be in force from and after its
1-51 passage, and it is so enacted.
