1-1                                   AN ACT

 1-2     relating to the slaughter and processing of livestock for personal

 1-3     use.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Section 433.006, Health and Safety Code, is

 1-6     amended to read as follows:

 1-7           Sec. 433.006.  Personal Use Exemption.  (a)  The provisions

 1-8     of this chapter requiring inspection of the slaughter of livestock

 1-9     [animals] and the preparation of carcasses, parts of carcasses,

1-10     meat, and meat food products at establishments conducting those

1-11     operations do not apply to the slaughtering of livestock [animals

1-12     by a person on the person's own premises,] or the preparation and

1-13     transportation in intrastate commerce of those articles if:

1-14                 (1)  the articles are exclusively for personal use by

1-15     the owner of the livestock, a member of the owner's family, or a

1-16     nonpaying guest of the owner;

1-17                 (2)  the slaughter or preparation is conducted at the

1-18     owner's premises or at a processing establishment; and

1-19                 (3)  the transportation is limited to moving the

1-20     carcasses, parts of carcasses, meat, and meat food products to and

1-21     from the owner's premises and a processing establishment [by the

1-22     person exclusively for use by the person or the person's household,

1-23     nonpaying guests, or employees].

1-24           (b)  The adulteration and misbranding provisions of this

 2-1     chapter, other than the requirement of an inspection legend, apply

 2-2     to [those] articles prepared by a processing establishment under

 2-3     Subsection (a).

 2-4           (c)  This section does not grant a personal use exemption to

 2-5     an owner who intends to give carcasses, parts of carcasses, meat,

 2-6     or meat food products to any person other than a person listed in

 2-7     Subsection (a)(1).

 2-8           SECTION 2.  Section 433.007(b), Health and Safety Code, is

 2-9     amended to read as follows:

2-10           (b)  This chapter applies to a person, establishment, animal,

2-11     or article regulated under the Federal Meat Inspection Act (21

2-12     U.S.C. Section 601 et seq.)  or the Federal Poultry Products

2-13     Inspection Act (21 U.S.C. Section 451 et seq.)  [only to the extent

2-14     provided by those Acts].

2-15           SECTION 3.  Section 433.008, Health and Safety Code, is

2-16     amended by adding Subsection (c) to read as follows:

2-17           (c)  The department may adopt rules requiring a processing

2-18     establishment that processes livestock under Section 433.006(a)(2)

2-19     to obtain a grant of custom exemption for that activity.

2-20           SECTION 4.  The importance of this legislation and the

2-21     crowded condition of the calendars in both houses create an

2-22     emergency and an imperative public necessity that the

2-23     constitutional rule requiring bills to be read on three several

2-24     days in each house be suspended, and this rule is hereby suspended,

2-25     and that this Act take effect and be in force from and after its

2-26     passage, and it is so enacted.
