1-1 AN ACT
1-2 relating to the interval between internal inspections of certain
1-3 boilers.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 755.026, Health and Safety Code, is
1-6 amended by amending Subsection (a) and adding Subsection (e) to
1-7 read as follows:
1-8 (a) With the approval of the commissioner and the inspection
1-9 agency that has jurisdiction for the power [that] boiler, the
1-10 interval between internal inspections [of a boiler] may be extended
1-11 to a period not exceeding a total of 48 [24] months [for power
1-12 boilers]. For other unfired steam boilers, the inspection interval
1-13 may be extended to the next scheduled downtime of the [that]
1-14 boiler, but not exceeding a total of 84 [60] months.
1-15 (e) If the interval between internal inspections of a gas
1-16 fired boiler is extended under Subsection (a), the commissioner and
1-17 inspection agency shall require that an inspection of the gas
1-18 regulator or pressure reducing valve that services the boiler be
1-19 performed as part of the next regularly scheduled external
1-20 certificate inspection of the boiler to verify proper venting of
1-21 gas to a safe point of discharge.
1-22 SECTION 2. This Act takes effect September 1, 1997.
1-23 SECTION 3. The importance of this legislation and the
1-24 crowded condition of the calendars in both houses create an
2-1 emergency and an imperative public necessity that the
2-2 constitutional rule requiring bills to be read on three several
2-3 days in each house be suspended, and this rule is hereby suspended.
