A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to clarifying the name of the College of Dentistry
1-3 component of The Texas A&M University System.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Chapter 87, Subchapter I, Education Code, is
1-6 amended to read as follows:
1-7 SUBCHAPTER I. THE TEXAS A&M UNIVERSITY SYSTEM--[BAYLOR]
1-8 COLLEGE OF DENTISTRY
1-9 Sec. 87.801. The Texas A&M University System--[Baylor] College
1-10 of Dentistry. (a) The Texas A&M University System--[Baylor] College
1-11 of Dentistry is a component institution of The Texas A&M University
1-12 System under the management and control of the board of regents of
1-13 The Texas A&M University System.
1-14 (b) The board has the same powers and duties concerning The
1-15 Texas A&M University System--[Baylor] College of Dentistry as are
1-16 conferred on it by law concerning Texas A&M University.
1-17 Sec. 87.802. Powers of Board. (a) The board may:
1-18 (1) provide for the training and teaching of students
1-19 seeking to become:
1-20 (A) dentists;
1-21 (B) dental hygienists; or
1-22 (C) other technicians who provide services
1-23 related to the practice of dentistry;
1-24 (2) prescribe courses leading to degrees customarily
2-1 offered in other leading United States dental schools;
2-2 (3) award the degrees described by Subdivision (2);
2-3 (4) enter into an affiliation or coordinating
2-4 agreement with an entity if reasonably necessary or desirable for
2-5 the operation of a first class school of dentistry;
2-6 (5) make joint appointments in The Texas A&M
2-7 University System--[Baylor] College of Dentistry and another
2-8 institution within The Texas A&M University System; and
2-9 (6) adopt rules for the operation, control, and
2-10 management of the college, as necessary for the operation of a
2-11 first class school of dentistry, including rules governing the
2-12 number of students that may be admitted to any program at the
2-13 college.
2-14 (b) The salary of the person who receives a joint
2-15 appointment under Subsection (a)(5) must be apportioned among the
2-16 institutions to which the individual is appointed on the basis of
2-17 the services rendered.
2-18 SECTION 2. The purpose of this Act is to provide a technical
2-19 correction to the statutory language of Subchapter I, Education
2-20 Code, inclusive of Sections 87.801 and 87.802, by deleting the
2-21 reference to Baylor in the name of the College of Dentistry.
2-22 Baylor University in Waco, Texas, has sole discretion regarding the
2-23 Baylor trademark, requiring consent by Baylor University prior to
2-24 use of the Baylor name. The appropriation of the Baylor name by a
2-25 third party is inconsistent with statutory authority regarding
2-26 trademarks, making it necessary to change the name of the Texas A&M
2-27 University System component to conform with applicable law
3-1 regarding trademarks.
3-2 SECTION 3. The importance of this legislation and the
3-3 crowded condition of the calendars in both houses create an
3-4 emergency and an imperative public necessity that the
3-5 constitutional rule requiring bills to be read on three several
3-6 days in each house be suspended, and this rule is hereby suspended,
3-7 and that this Act take effect and be in force from and after its
3-8 passage, and it is so enacted.
