1-1                                   AN ACT

 1-2     relating to the Lamar County Juvenile Board.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Section 152.1451, Human Resources Code, is

 1-5     amended to read as follows:

 1-6           Sec. 152.1451.  LAMAR COUNTY.  (a)  The Lamar County Juvenile

 1-7     Board is composed of:

 1-8                 (1)  the county judge;

 1-9                 (2)  the statutory county court at law judge;

1-10                 (3)  [and] the district judges in Lamar County; and

1-11                 (4)  one member of the commissioners court selected by

1-12     and from among the members of the commissioners court.

1-13           (b)  The juvenile board shall elect one of its members as

1-14     chairman at its first regular meeting of each fiscal year.  The

1-15     board shall hold regular meetings each year on dates set by the

1-16     board and special meetings at the call of the chairman [court judge

1-17     is the chairman of the board and its chief administrative officer].

1-18           (c)  Service on a juvenile board by a judge is an additional

1-19     duty of office.  The commissioners court may pay the board chairman

1-20     and other board members additional annual compensation [of $2,400]

1-21     for the additional [added] duties imposed on the chairman and the

1-22     other board  members.  [The commissioners court may pay the other

1-23     board members additional annual compensation of not more than

1-24     $2,400.]  The compensation shall be paid in equal monthly

 2-1     installments from the general fund or any other available fund of

 2-2     the county.

 2-3           (d)  The juvenile board shall recommend to the commissioners

 2-4     court proposed salaries for juvenile probation officers and other

 2-5     juvenile probation employees.  The commissioners court shall set

 2-6     the salaries of juvenile probation officers and other juvenile

 2-7     probation employees after considering the recommendation of the

 2-8     juvenile board and any other relevant factors, including the source

 2-9     of funds, the duties and workload of the employees, and the effect

2-10     on other county employees.  The commissioners court shall comply

2-11     with all applicable laws when setting the salaries of juvenile

2-12     probation officers and other juvenile probation employees.

2-13           (e)  Sections 152.0002, 152.0004, 152.0005, 152.0006,

2-14     152.0007, and 152.0008 do not apply to the juvenile board of Lamar

2-15     County.

2-16           SECTION 2.  This Act takes effect September 1, 1997.

2-17           SECTION 3.  The importance of this legislation and the

2-18     crowded condition of the calendars in both houses create an

2-19     emergency and an imperative public necessity that the

2-20     constitutional rule requiring bills to be read on three several

2-21     days in each house be suspended, and this rule is hereby suspended.
