A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the Lamar County Juvenile Board.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 152.1451, Human Resources Code, is
1-5 amended to read as follows:
1-6 Sec. 152.1451. LAMAR COUNTY. (a) The Lamar County Juvenile
1-7 Board is composed of:
1-8 (1) the county judge;
1-9 (2) the statutory county court at law judge;
1-10 (3) [and] the district judges in Lamar County;
1-11 (4) two members of the commissioners court selected by
1-12 and from among the members of the commissioners court; and
1-13 (5) one superintendent of a school district located in
1-14 whole or in part in Lamar County selected by the superintendents of
1-15 the school districts located in whole or in part in Lamar County.
1-16 (b) The juvenile board shall elect one of its members as
1-17 chairman at its first regular meeting of each fiscal year. The
1-18 board shall hold regular meetings each year on dates set by the
1-19 board and special meetings at the call of the chairman [court judge
1-20 is the chairman of the board and its chief administrative officer].
1-21 (c) Service on a juvenile board by a judge is an additional
1-22 duty of office. The commissioners court may pay the board chairman
1-23 and other board members additional annual compensation [of $2,400]
1-24 for the additional [added] duties imposed on the chairman and the
2-1 other board members. [The commissioners court may pay the other
2-2 board members additional annual compensation of not more than
2-3 $2,400.] The compensation shall be paid in equal monthly
2-4 installments from the general fund or any other available fund of
2-5 the county.
2-6 (d) The juvenile board shall recommend to the commissioners
2-7 court proposed salaries for juvenile probation officers and other
2-8 juvenile probation employees. The commissioners court shall set
2-9 the salaries of juvenile probation officers and other juvenile
2-10 probation employees after considering the recommendation of the
2-11 juvenile board and any other relevant factors, including the source
2-12 of funds, the duties and workload of the employees, and the effect
2-13 on other county employees. The commissioners court shall comply
2-14 with all applicable laws when setting the salaries of juvenile
2-15 probation officers and other juvenile probation employees.
2-16 (e) Sections 152.0002, 152.0004, 152.0005, 152.0006,
2-17 152.0007, and 152.0008 do not apply to the juvenile board of Lamar
2-18 County.
2-19 SECTION 2. This Act takes effect September 1, 1997.
2-20 SECTION 3. The importance of this legislation and the
2-21 crowded condition of the calendars in both houses create an
2-22 emergency and an imperative public necessity that the
2-23 constitutional rule requiring bills to be read on three several
2-24 days in each house be suspended, and this rule is hereby suspended.
