 1-8                            A BILL TO BE ENTITLED

 1-9                                   AN ACT

1-10     relating to the Lamar County Juvenile Board.

1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

1-12           SECTION 1.  Section 152.1451, Human Resources Code, is

1-13     amended to read as follows:

1-14           Sec. 152.1451.  LAMAR COUNTY.  (a)  The Lamar County Juvenile

1-15     Board is composed of:

1-16                 (1)  the county judge;

1-17                 (2)  the statutory county court at law judge;

1-18                 (3)  [and] the district judges in Lamar County; and

1-19                 (4)  one member of the commissioners court selected by

1-20     and from among the members of the commissioners court.

1-21           (b)  The juvenile board shall elect one of its members as

1-22     chairman at its first regular meeting of each fiscal year.  The

1-23     board shall hold regular meetings each year on dates set by the

1-24     board and special meetings at the call of the chairman [court judge

1-25     is the chairman of the board and its chief administrative officer].

1-26           (c)  Service on a juvenile board by a judge is an additional

1-27     duty of office.  The commissioners court may pay the board chairman

1-28     and other board members additional annual compensation [of $2,400]

1-29     for the additional [added] duties imposed on the chairman and the

1-30     other board  members.  [The commissioners court may pay the other

1-31     board members additional annual compensation of not more than

1-32     $2,400.]  The compensation shall be paid in equal monthly

1-33     installments from the general fund or any other available fund of

1-34     the county.

1-35           (d)  The juvenile board shall recommend to the commissioners

1-36     court proposed salaries for juvenile probation officers and other

1-37     juvenile probation employees.  The commissioners court shall set

1-38     the salaries of juvenile probation officers and other juvenile

1-39     probation employees after considering the recommendation of the

1-40     juvenile board and any other relevant factors, including the source

1-41     of funds, the duties and workload of the employees, and the effect

1-42     on other county employees.  The commissioners court shall comply

1-43     with all applicable laws when setting the salaries of juvenile

1-44     probation officers and other juvenile probation employees.

1-45           (e)  Sections 152.0002, 152.0004, 152.0005, 152.0006,

1-46     152.0007, and 152.0008 do not apply to the juvenile board of Lamar

1-47     County.

1-48           SECTION 2.  This Act takes effect September 1, 1997.

1-49           SECTION 3.  The importance of this legislation and the

1-50     crowded condition of the calendars in both houses create an

1-51     emergency and an imperative public necessity that the

1-52     constitutional rule requiring bills to be read on three several

1-53     days in each house be suspended, and this rule is hereby suspended.
