1-1                                   AN ACT

 1-2     relating to the placement of signs along certain public roads.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Section 393.002, Transportation Code, is amended

 1-5     to read as follows:

 1-6           Sec. 393.002.  SIGN PLACEMENT PROHIBITED.  Except as provided

 1-7     by Section 393.0025, a [A] person may not place a sign on the

 1-8     right-of-way of a public road unless the placement is authorized by

 1-9     state law.

1-10           SECTION 2.  Chapter 393, Transportation Code, is amended by

1-11     adding Section 393.0025 to read as follows:

1-12           Sec. 393.0025.  MUNICIPAL AUTHORITY TO REGULATE SIGN

1-13     PLACEMENT.  (a)  A person may not place a sign on the right-of-way

1-14     of a road or highway maintained by a municipality unless the

1-15     placement is authorized by the municipality.

1-16           (b)  This section does not apply to the right-of-way of a

1-17     road or highway in the state highway system.

1-18           SECTION 3.  This Act takes effect September 1, 1997.

1-19           SECTION 4.  The importance of this legislation and the

1-20     crowded condition of the calendars in both houses create an

1-21     emergency and an imperative public necessity that the

1-22     constitutional rule requiring bills to be read on three several

1-23     days in each house be suspended, and this rule is hereby suspended.
