 1-9                                   AN ACT

1-10     relating to the placement of signs along certain public roads.

1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

1-12           SECTION 1.  Section 393.002, Transportation Code, is amended

1-13     to read as follows:

1-14           Sec. 393.002.  SIGN PLACEMENT PROHIBITED.  Except as provided

1-15     by Section 393.0025, a [A] person may not place a sign on the

1-16     right-of-way of a public road unless the placement is authorized by

1-17     state law.

1-18           SECTION 2.  Chapter 393, Transportation Code, is amended by

1-19     adding Section 393.0025 to read as follows:

1-20           Sec. 393.0025.  MUNICIPAL AUTHORITY TO REGULATE SIGN

1-21     PLACEMENT.  A person may not place a sign on the right-of-way of a

1-22     road or highway maintained by a municipality unless the placement

1-23     is authorized by the municipality.

1-24           SECTION 3.  This Act takes effect September 1, 1997.

1-25           SECTION 4.  The importance of this legislation and the

1-26     crowded condition of the calendars in both houses create an

1-27     emergency and an imperative public necessity that the

1-28     constitutional rule requiring bills to be read on three several

1-29     days in each house be suspended, and this rule is hereby suspended.
