1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to notice to an owner or operator of a motor vehicle of
1-9 security required following an accident.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Section 601.155, Transportation Code, is amended
1-12 by amending Subsection (c) and adding Subsection (d) to read as
1-13 follows:
1-14 (c) Notice under this section that is mailed must be mailed
1-15 [by certified mail, return receipt requested,] to the person's last
1-16 known address, as shown by the department's records.
1-17 (d) For purposes of this section, notice is presumed to be
1-18 received if the notice was mailed to the person's last known
1-19 address, as shown by the department's records.
1-20 SECTION 2. This Act takes effect September 1, 1997.
1-21 SECTION 3. The importance of this legislation and the
1-22 crowded condition of the calendars in both houses create an
1-23 emergency and an imperative public necessity that the
1-24 constitutional rule requiring bills to be read on three several
1-25 days in each house be suspended, and this rule is hereby suspended.
