                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the requirement of a driving safety course for renewal

 1-3     of certain persons' driver's licenses.

 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Subchapter M, Chapter 521, Transportation Code,

 1-6     is amended by adding Section 521.275 to read as follows:

 1-7           Sec. 521.275.  DRIVING SAFETY COURSE.  (a)  The department

 1-8     may not renew the driver's license of an applicant who as of the

 1-9     date of the application is a habitual violator unless the applicant

1-10     successfully completed a driving safety course approved under the

1-11     Texas Driver and Traffic Safety Education Act (Article 4413(29c),

1-12     Vernon's Texas Civil Statutes) during the year preceding the date

1-13     of the application.

1-14           (b)  For the purposes of this section, a "habitual violator"

1-15     is a person described by Section 521.294(h).

1-16           SECTION 2.  The change in law made by this Act applies only

1-17     to  the renewal of a driver's license for which an application is

1-18     filed on or after the effective date of this Act.  A renewal for

1-19     which an application is filed before the effective date of this Act

1-20     is governed by the law in effect when the application was filed,

1-21     and the former law is continued in effect for that purpose.

1-22           SECTION 3.  This Act takes effect September 1, 1997.

1-23           SECTION 4.  The importance of this legislation and the

1-24     crowded condition of the calendars in both houses create an

 2-1     emergency and an imperative public necessity that the

 2-2     constitutional rule requiring bills to be read on three several

 2-3     days in each house be suspended, and this rule is hereby suspended.
